A Half Sensible Objection on Miers

        Kaus points out that someone as close to the President as Miers is to Bush might have conflicted loyalties.  Well, maybe.  But Truman appointed people close to him, and no one seems to have had a conniption.  Why the change?

        Further, Miers can recuse herself if she's judging a case involving the Administration.

        For that matter, Ginsberg and Breyer got onto the Court because of Clinton, but I don't recall anyone saying their gratitude might lead to them being biased towards the Democratic Party and members of the Clinton administration.  Perhaps I err, but I don't recall any Democrats calling for them to recuse themselves from Bush vs. Gore — including Kaus.  So I think what's really involved here is that Democrats want to impose a standard on Republicans that they don't impose on themselves.

        What a surprise.
